SB 1172: state capitol museum; transfer

Overview
Transfers the State Capitol Museum (Museum) management to the Arizona Legislative Council.
History
Legislative Council is responsible for the renovation, alteration, operation, control and allocation of space of the following:
1) The original 1898 statehouse area of the state capitol building known as the State Capitol Museum;
2) The 1919 wing and the 1938 justice addition of the state capitol building known together as the legislative services wing;
3) Any other facility acquired for legislative use and placed under Legislative Council's jurisdiction and the grounds adjacent; and
4) The grounds adjacent to the state capitol complex area (A.R.S. § 41-1304.05).
Provisions
1.
Repeals statute relating to the
management of the Museum. (Sec. 1)
2. Transfers the direction and management of the Museum to the director of the Arizona Legislative Council. (Sec. 2)
3. Specifies that the director of the Arizona Legislative Council must administer the Museum Gift Shop Revolving Fund. (Sec. 3)
4. Repeals statute and session law relating to the succession of the Museum. (Sec. 4)
5. States that the Arizona Legislative Council succeeds to the authority, duties, powers and responsibilities of the Secretary of State (SOS) regarding the Museum. (Sec. 5)
6. Maintains that these provisions do not alter the effect of any actions that were taken or impair the valid obligations of the SOS regarding the Museum before the general effective date. (Sec. 5)
7. Stipulates that any contracts, administrative matters, judicial and quasi-judicial actions, no matter the status, of the SOS regarding the Museum are transferred on the general effective date to and retain the same status with the Legislative Council. (Sec. 5)
8. Asserts that all registrations, licenses, permits, certificates and other indicia of qualification and authority issued by the SOS regarding the Museum retain their validity for the duration of their terms provided by law. (Sec. 5)
9. States that all SOS furnishings, equipment, records and other property, all data and investigative findings, all appropriated monies and obligations that remain unencumbered and unexpended on the general effective date regarding the Museum are transferred to the Legislative Council. (Sec. 5)
10. Provides that all personnel employed by the SOS regarding the Museum are transferred to comparable positions, on the general effective date, in the respective administrative units of the Legislative Council. (Sec. 5)
