SB 1173: community colleges; out-of-county reimbursement

Overview

An emergency measure that determines, from the total reimbursement amount established in statute, the reimbursement amount a county that is not part of a community college district (CCD) must pay for students who attend a CCD and the reimbursement amount to be paid by the state General Fund (GF).

History

A CCD may admit students from any part of the state that is not part of an established CCD on the same conditions as residents of the CCD. Currently, if a student resides in a county that is not part of an established CCD, the county must reimburse the CCD. This amount is determined according to a statutory formula that considers full-time equivalent student (FTSE) count for the CCD and county not part of a CCD and the CCD's operational expenses and allocated state aid. The reimbursement amount for students attending classes offered by the CCD within their county of residence is determined according to an intergovernmental agreement between the CCD and county.

Statute requires the Joint Legislative Budget Committee (JLBC) staff to annually determine the reimbursement amount to each CCD from each county and notify each county board of supervisors of the amount it must reimburse each CCD (A.R.S. § 15-1469).

There are 10 CCDs and 2 provisional CCDs in Arizona. Only Apache and Greenlee counties are not part of an established CCD (JLBC Baseline).

Provisions

1.   Calculates the reimbursement amount a county that is not part of a CCD must pay to a CCD for students who reside in the county and who attend classes in the CCD as follows:

a)   Dividing the CCD's primary property tax levy amount from the current fiscal year by the CCD's FTSE for the current year; and

b)   Multiplying this amount by the FTSE attending classes within the CCD from the county for the year preceding the current year. (Sec. 1)

3.   Instructs JLBC staff to annually determine the reimbursement amounts that each county and the state must pay to each CCD. (Sec. 1)
