Overview

Removes the Peace Officer's Training Fund (Training Fund) from the list of entities who receive monies from the Criminal Justice Enhancement Fund (CJE Fund). Appropriates $5,000,000 to the Training Fund.

History

The CJE Fund consists of a 42% penalty assessment on fines, violations, forfeitures and penalties imposed by the courts for criminal offenses and civil motor vehicle statute violations. Monies in the fund are distributed to various agencies for statutorily specified purposes. In FY 2021, the CJE Fund distributed a total of $26,629,200 (A.R.S. §§ 12-116.01; 41-2401; JLBC 2023 Baseline, Criminal Justice Commission).

The Training Fund is overseen by the Arizona Peace Officer Standards and Training Board (AZPOST). Its monies are used for the costs of training state, local and Indian tribal peace officers and for the operating expenses of AZPOST. The Training Fund primarily receives its monies from the CJE Fund; it receives 18.97% of the monies deposited in the CJE Fund. However, due to the CJE Fund experiencing a steady decline in revenue since FY 2009, the Training Fund has been supplemented with legislative appropriations in FYs 2019, 2020 and 2022. In FY 2021, the Training fund received $5,134,800 from the CJE Fund (A.R.S. § 41-1825; JLBC Law Enforcement Training; JLBC 2023 Baseline, Criminal Justice Commission).

Provisions

2.   Raises the percentage of monies distributed from the CJE Fund to the remaining recipients as follows:

a)   19.09% to 20.81% to the Department of Public Safety (DPS) Forensics Fund;

b)   2.62% to 4.34% to the DPS Forensics Fund;

c)   8.29% to 10.01% to DPS to distribute to law enforcement authorities for specified purposes;

d)   10.66% to 12.38% to the Supreme Court to reduce juvenile crime;

e)   2.43% to 4.16% to the Supreme Court to provide drug treatment services to adult probationers;

f) 6.86% to 8.59% to the Supreme Court for specified purposes;

g)   1.84% to 3.57% to the Arizona Department of Juvenile Corrections to treat and rehabilitate juveniles with drug-related offences;

h)   3.45% to 5.18% to the Prosecuting Attorneys' Advisory Council Training Fund;

i)   10.66% to 12.38% to the Department of Law to allocate to county attorneys;

j)   13.34% to 15.06% to county sheriffs to enhance county jails; and

k)   1.79% to 3.52% to the Arizona Criminal Justice Commission. (Sec. 2)

3.   Appropriates $5,000,000 from the General Fund in FY 2023 to the Training Fund. (Sec. 3)

4.   Exempts the appropriation to the Training Fund from lapsing. (Sec. 3)
