SB 1203: health care institutions; architectural plans

Overview
Requires a health care institution to include on a form provided by the Department of Health Services (DHS), a notarized attestation from a registered architect verifying that the architectural plans and specifications meet or exceed DHS's standards.
History
The Director of DHS (Director) must adopt rules to establish minimum standards and requirements for constructing, modifying and licensing health care institutions necessary to ensure the public health, safety and welfare. Statute outlines the powers and duties of the Director which include the ability to establish by rule nonrefundable application and licensing fees and fees for architectural plans and specifications reviews (A.R.S. § 36-405).
A license application for a health care institution is required to include architectural plans and specifications or DHS's approval of the architectural plans and specifications. The plans and specifications must meet the minimum standards for licensure within the class or subclass of the health care institution it is intended for (A.R.S. § 36-421).
Statute outlines what a person wishing to apply for a license to operate a health care institution must submit to DHS, which includes the architectural plans and specifications or DHS's approval of the architectural plans and specifications (A.R.S. § 36-422).
Laws 2021, Chapter 405, Sec. 10 amended statute to allow the Director to adopt rules regarding the collection of data from health care institutions.
Provisions
1. Removes the Director's authority to establish fees for architectural plans and specifications reviews. (Sec. 2)
2. Requires a license application for a health care institution to include on a form provided by DHS, a notarized attestation from a registered architect verifying that the architectural plans and specifications meet or exceed DHS's adopted standards. (Sec. 3)
3. Removes the requirement for a health care institution license application to include the institution's architectural plans and specifications or DHS's approval of the plans and specifications. (Sec. 3)
4. Specifies that a person wishing to apply for a license to operate a health care institution must submit to DHS the notarized attestation form from a licensed architect verifying that the architectural plans and specifications meet or exceed DHS's standards, rather than the architectural plans and specifications or DHS's approval of the plans and specifications. (Sec. 4)
5. Repeals statutory changes made by Laws 2021, Chapter 405, Sec. 10 (Sec. 1)
