SB 1251: armed robbery; deadly weapon; classification

Overview

Classifies the act of taking possession or attempting to take possession of a deadly weapon during the commission of a robbery, as armed robbery.

History

There are three classifications of robbery under Arizona law: robbery, aggravated robbery and armed robbery

A person commits robbery if, while taking a person's property against their will, the individual threatens or uses force against the person with the intent to coerce the person to surrender the property or to prevent resistance.  Robbery is a class 4 felony (A.R.S. § 13-1902).

Aggravated robbery occurs when a person commits the crime of robbery while accompanied by one or more individuals. Aggravated robbery is a class 3 felony (A.R.S. § 13-1903). 

A person commits armed robbery, a class 2 felony, if, while committing robbery, the person does either of the following:

1)   Is in possession of a deadly weapon or a simulated deadly weapon; or

2)   Uses or threatens to use a deadly weapon, dangerous instrument or simulated deadly weapon (A.R.S. § 13-1904).
