SB 1273: two-wheeled motorcycle operation

Overview

Enables an operator of a two-wheeled motorcycle to overtake and pass another vehicle that is stopped and in the same direction and lane and to operate the motorcycle between lanes of traffic if the movement may be done safely and only in specified circumstances.

History

A person is required to drive a vehicle as nearly as practicable entirely within a single lane and is prohibited from moving the vehicle from that lane until the driver has first ascertained that the movement can be made safely (A.R.S. § 28-729).

All motorcycles are entitled to the full use of a lane. A person is prohibited from driving a motor vehicle in such a manner as to deprive any motorcycle of the full use of a lane. This prohibition does not apply to motorcycles operating two abreast in a single lane.

A person is prohibited from operating a motorcycle:

1)   From overtaking and passing in the same lane occupied by the vehicle being overtaken;

2)   Between the lanes of traffic or between adjacent rows of vehicles; and

3)   More than two abreast in a single lane (A.R.S. § 28-903).

a)   The operator is on a street that is divided into at least two adjacent traffic lanes in the same direction of travel;

b)   The operator is on a street with a speed limit that does not exceed 45 miles per hour; and

c)   The motorcycle is traveling at a speed that does not exceed 15 miles per hour. (Sec. 1)
