SB 1275: fireworks; use; overnight hours; prohibition

Overview

Stipulates usage times for permissible consumer fireworks.

History

Currently, the regulations for the use and sale of fireworks in the state of Arizona are as follows:

1)   The use of consumer fireworks is allowed from May 4 – May 6, June 24 – July 6 and December 24 – January 3;

2)   The sale of consumer fireworks is allowed from April 25 – May 6, May 20 – July 6 and December 10 – January 3;

3)   The sale and use of pop-its, party poppers, glow worms, snakes, toy smoke devices and sparklers are permitted at all times;

4)   All other fireworks are prohibited, except as authorized by a local fire department permit; and

5)   Consumer fireworks must not be sold to anyone under 16 years of age (A.R.S. § 36-1606).

The use of consumer fireworks is prohibited in locations within a one-mile radius of:

1)   A city or town that has purchased more than 15,000 acres of land for preservation purposes; or

2)   The border of any municipal or county mountain preserve, desert park, regional park, designated conservation area, national forest or wilderness area on days during a stage one or higher fire restriction (A.R.S. § 36-1606).

Consumer fireworks may not be sold on days when a stage one or higher fire restriction is in place (A.R.S. § 36-1606).

Provisions

1.   Prohibits the use of fireworks everyday between 11:00 P.M. and 8:00 A.M. except:

a)   From 11:00 P.M. on December 31 through 1:00 A.M. on January 1 each year; and
