SB 1333: neighborhood occupantless electric vehicles

Overview
Outlines requirements and operational restrictions for neighborhood occupantless electric vehicles (NOEV)
History
A NOEV is a self-propelled motor vehicle that: 1) is emission free; 2) has at least four wheels in contact with the ground; and 3) complies with the definition and standards for low speed vehicles set forth in federal law (A.R.S. § 28-101).
Provisions
1.
Prohibits a NOEV from operating,
stopping or parking in a bicycle path, except in an emergency or to cross the
path to gain access to another roadway. (Sec. 3)
2. Allows a NOEV to be operated on a highway that has a posted speed limit of 45 miles per hour or less. (Sec. 3)
3. Allows a NOEV to cross a highway with a posted speed limit of more than 45 miles per hour at an intersection. (Sec.3)
4. Prohibits a NOEV from:
a) operating on a highway in which the Director of the Arizona Department of Transportation (ADOT) or local authorities within their respective jurisdictions have determined and declared a minimum speed limit of more than 25 miles per hour, except when crossing at a highway intersection;
b) operating, on roadways within the boundaries of a public airport without express permission from the airport owner; and
c) transporting hazardous materials that are regulated under the Hazardous Materials Transportation Authorization Act of 1994. (Sec. 3)
5. Requires a NOEV, when operating on a highway with a posted speed limit between 35 and 45 miles per hour to:
a) operate in the right-hand travel lane or as close as practicable to the right-hand curb or edge of the highway, except when preparing for a left hand turn;
b) turn off the roadway, on a highway with two travel lanes, to a controlled stop as soon as practicable and when it is safe to do so to allow faster moving vehicles to pass when passing is unsafe because of traffic in the opposite direction or other conditions, while there are five or more vehicles immediately behind the vehicle; and
c) display a slow-moving vehicle sign that follows specified details. (Sec. 3)
6. Defines highway as a street or roadway. (Sec. 3)
7. Makes technical and conforming changes. (Sec. 1, 2)

1. States that NOEVs are subject to law relating to autonomous vehicles.
