Overview
Repeals, effective July 1, 2023, the licensure requirement for pharmacy technician trainees and instead requires pharmacy technician trainee applicants to register with the Board of Pharmacy (Board). Modifies outlined acts of unethical conduct within the practice of pharmacy and establishes requirements for a remote hospital-site pharmacy permittee.
History
The Board protects the public and oversees the practice of pharmacy by issuing licenses and permits, investigating and resolving complaints and providing information to the public about the status of licenses and permit holders. Additionally, statute outlines what is considered to be unethical conduct in the practice of pharmacy (A.R.S. §§ 32-1901.01 and 32-1904).
An applicant for licensure as a pharmacy technician trainee must submit with the application fee prescribed by the board which can not exceed $100. A license expires 36 months after it is issued and can not be renewed or reissued. An applicant for licensure as a pharmacy technician trainee must:
1) Be of a good moral character;
2) Be at least 18 years old; and
3) Have a high school diploma or a high school diploma equivalent (A.R.S. §§ 32-1923.01, 32-1924).
Provisions
Pharmacy Technician Trainees Registration
1. Deletes the licensure requirement of a pharmacy technician trainee. (Sec. 5)
2. Directs a pharmacy technician trainee applicant to register with the board through an online application. (Sec. 5)
3. Allows a pharmacy technician trainee to apply for a licensure as a pharmacy technician within 36 months after registering as a pharmacy technician trainee. (Sec. 6)
4. Repeals the requirement that a pharmacy technician trainee applicant be of good moral character and have a high school diploma or the equivalent of a high school diploma. (Sec. 5)
5. Reduces, from $100 to $25, the maximum pharmacy technician trainee application fee. (Sec. 6)
6. Requires registrants to create an online profile using the board's licensing software. (Sec. 6)
Remote Hospital-Site Pharmacies
7. Deletes and replaces statutory references to a pharmacy operating in connection with a hospital with remote hospital-site pharmacies. (Sec.10)
8. Requires a remote hospital-site pharmacy to comply with Board rules and all applicable state and federal laws. (Sec.10)
9. Establishes requirements for a remote hospital-site pharmacy permittee. (Sec. 10)
10. Permits a pharmacist to engage simultaneously in the practice of pharmacy at a reasonable number of remote hospital-site pharmacies as determined and approved by the hospital. (Sec.10)
11. Allows the Board to adopt additional rules necessary to implement requirements regarding remote hospital-site pharmacy permittees. (Sec.10)
12. Allows, rather than requires, a pharmacy technician trainee to apply for a license as a pharmacy technician within 36 months after registering as a pharmacy technician trainee. (Sec.10)
13. Contains a delayed effective date of July 1, 2023, for the pharmacy technician trainee registration requirements. (Sec. 13)

Deletes from the definition of unethical
conduct failing to report, in writing to the Board, any evidence that:
a) A pharmacist or pharmacy intern is or may be professionally incompetent, is or may be guilty of unprofessional conduct or is or may be physically or mentally unable to safely engage in the practice of pharmacy;
b) A pharmacy technician or pharmacy technician trainee is or may be guilty of unprofessional conduct, is or may be professionally incompetent or is or may be mentally or physically unable to safely engage in the permissible activities of a pharmacy technician or pharmacy technician trainee; and
c) Appears to show that a permittee or permittee's employee is or may be guilty of unethical conduct, is or may be physically and mentally unable to safely engage in employment duties related to manufacturing, distributing, selling or dispensing drugs, devices, poisons, hazardous substances, controlled substances or precursor chemicals or is or may be violating applicable law or rule. 19. Makes technical and conforming changes. (Sec. 1-9,11-12).
