SB 1637: health professionals; business entities; interference

Overview

Permits specified licensed health care professionals to engage in the practice of medicine in any form of business entity.

History

The practice of medicine for a Doctor of Medicine is the diagnosis, treatment, correction, attempt or claim to be able to diagnose, treat or correct any and all human diseases, injuries, ailments, infirmities or deformities, physical or mental, real or imaginary, by any means, methods, devices or instrumentalities. This includes the practice of medicine alone or the practice of surgery or both  (A.R.S. § 32-1401).

The practice of osteopathic medicine means all of the following: 1) To examine, diagnose, treat, prescribe, palliate, prevent or correct human diseases, injuries, ailments, deformities, physical or mental conditions, real or imaginary, by the use of drugs, surgery, manipulation, electricity or any physical, mechanical or other means; and 2) Suggesting, recommending, prescribing or administering any form of treatment, operation or healing for the intended palliation, relief or cure of any physical or mental disease, ailment, injury, condition or defect. This includes the practice of osteopathic medicine alone or the practice of osteopathic surgery or manipulative therapy or combination of either practice (A.R.S. § 32-1800).

The practice of naturopathic medicine is the diagnosing and treating of disease, injuries, ailments, infirmities and other conditions of the human mind and body, including by natural means, drugless methods, drugs, nonsurgical methods, devices, physical, electrical, hygienic and sanitary measures and all forms of physical agents and modalities (A.R.S. § 32-1501).

A nurse practitioner is a registered nurse who has an expanded scope of practice within a specialty area, including assessing clients, synthesizing and analyzing data, understanding and applying principles of health care, managing the physical and psychosocial health of patients, identifying and implementing appropriate treatment and other specified duties (A.R.S. § 32-1601).

Statute defines a physician assistant as a person licensed to practice medicine under physician supervision (A.R.S. § 32-2501).
