History
An immobilizing or impounding agency (agency) must release a vehicle before the end of its immobilization or impoundment period to the spouse of the registered owner or any person identified as an owner of the vehicle on the Arizona Department of Transportation's (ADOT) records at the time of removal if the spouse or person was not driving the vehicle at the time of removal and the spouse or person enters into an agreement with the agency which stipulates that if the spouse or person allows a driver without a valid driver's license or a driver who commits a violation that causes the vehicle to be removed and either immobilized or impounded within one year of any agreement signed by the agency, the spouse or person will be unable to obtain the release of the vehicle before the end of the immobilization or impoundment period (A.R.S. § 28-3512).
Within three business days excluding weekends and holidays after immobilization or impoundment, the agency must mail or personally deliver notice of immobilization or storage to the owner of the vehicle. Statute details what is required to be included in the notice (A.R.S. § 28-3514).
Provisions
1. Directs an agency to prominently display a notice in each of its offices of the requirements specified in law regarding the release of a vehicle before the end of the immobilization or impoundment period to the spouse of a registered owner or any other person identified as an owner of the vehicle who was not the driver of the vehicle at the time of immobilization or impoundment. (Sec. 1)
2. Specifies that within three days after immobilization or impoundment the agency must mail or personally deliver a written notice of immobilization or storage to the vehicle's owner. (Sec. 2)
3. Requires the notice of immobilization or notice to include a statement as to how the owner, their spouse, their agent or a person identified in ADOT's records as having an interest in the vehicle immediately before its immobilization or impoundment may retrieve the vehicle. (Sec. 2)
