Summary of the Strike-Everything Amendment to SB 1707
Overview
Establishes the Community Treatment Program for Imprisoned Women (Program). Appropriates $2,000,000 from the state General Fund (GF) to the Arizona Department of Corrections (ADC) in FY 2023 for the Program.
History
ADC encompasses the various institutions, facilities and programs who are part of the state's correctional program for the institutionalization, rehabilitation and community supervision functions of all adult offenders (A.R.S. § 41-1602).
In addition to maintaining and administering prisons, ADC also maintains community correctional centers and administers all community supervision services (A.R.S. §§ 41-1604, 41-1613).
Provisions
1. Establishes the Program within ADC. (Sec. 1)
2. Directs ADC to contract with a nonprofit entity to provide a community treatment center for a woman who has recently given birth to live with her child or children. (Sec. 1)
3. Requires ADC to adopt rules for the Program, including eligibility requirements. (Sec. 1)
4. Outlines services that the Program must provide, including:
a) Substance abuse treatment;
b) Well-being and emotional supports;
c) Parenting skills;
d) Education and employment skills;
e) Financial literacy; and
f) Workplace skills training. (Sec. 1)
5. Mandates the nonprofit entity provide pediatric care, an environment for the children, programs to ensure the stability of the parent-child relationship and the least restrictive alternative to incarceration consistent with public safety and justice. (Sec. 1)
6. Directs ADC to place up to 20 women in the Program in the first year and up to 50 women in second and following years. (Sec. 1)
7. States eligibility criteria that an inmate must be a woman who gives birth to a child while imprisoned and is scheduled to be released in five years or less. (Sec. 1)
8. Specifies that a child who resides at the community treatment center is not subject to security restrictions except as necessary for the child's safety or the facility's security. (Sec. 1)
9. Appropriates $2,000,000 from the GF to ADC in FY 2023 for the Program and exempts the appropriation from lapsing. (Sec. 2)
