Overview
Establishes the Law Enforcement Crime Victim Notification Fund (Fund); appropriates $3,800,000 to the Fund and $1,400,000 to the Victims' Rights Fund from the state General Fund (GF).
History
The Victims' Rights Fund consists of certain court fees and penalties and of legislative appropriations. The Victims' Rights Fund is administered by the Arizona Attorney General for the purpose of operating the Victims' Rights Program. The Victims' Rights Program disburses monies to state and local entities that are responsible for ensuring crime victims' access to justice (A.R.S. §§ 41-191.06; 41-191.08).
The Criminal Justice Information Services Division (CJIS) is a division of the FBI that provides criminal justice information to law enforcement agencies, national security agencies, the intelligence community and the general public.
Provisions
1. Establishes the Fund consisting of legislative appropriations and specifies that the monies are subject to legislative appropriation. (Sec. 1)
2. Directs the State Treasurer to administer the Fund. (Sec. 1)
3. Allows public safety agencies in Arizona to use monies in the Fund to fund software which:
a) Enables the county-based deployment of an automated crime victim notification system to a user base consisting of law enforcement and prosecuting agencies; and
b) Provides a CJIS-compliant automated victim notification platform. (Sec. 1)
4. Requires the county-based automated crime victim notification system to:
a) Notify the victim of specified information regarding the crime report, investigation and case;
b) Provide configurable triggers to send messages to victims;
c) Allow victims to find their case status on the agency's website; and
d) Meet various specified information requirements and capabilities. (Sec. 1)
5. Requires the automated victim notification platform to:
a) Ensure victims are automatically notified by text message and email following any updates to their case;
b) Permit law enforcement agencies to determine the notifications sent to victims;
c) Allow victims to be able to proactively locate their case status online; and
d) Not require any additional staffing. (Sec. 1)
6. Requires a vendor of software paid through the Fund to have previously deployed a solution for a city police department, sheriff's office and prosecutor's office. (Sec. 1)
7. Appropriates $3,800,000 from the GF to the Fund in FY 2023. (Sec. 2)
8. Appropriates $1,400,000 from the GF to the Victims' Rights Fund in FY 2023. (Sec. 2)
9. Exempts the appropriated monies in this act from lapsing. (Sec. 2)
