medical procedures; prohibitions
Purpose
Prohibits government entities and persons doing business in Arizona from requiring a resident to submit to a medical procedure, including a vaccination, if a potential complication may be the individual's death.
Background
Health care institution administrators must
ensure that each patient, or their representative, is informed of the patient's
right to: 1) consent to or refuse treatment, except in an emergency;
2) refuse or withdraw consent for treatment before treatment is initiated; 3)
be informed of proposed treatment alternatives, associated risks and possible
complications, except in an emergency; and 4) be informed of the recovery care
center’s policy on health care (A.A.C.
R9-10-2110).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Prohibits a government entity or any person doing business in Arizona from requiring a resident to submit to a medical procedure, including a vaccination, if a potential complication from the medical procedure may cause the individual's death.
2. Defines government entity as the state and any political subdivision of the state that receives and uses tax revenues.
3. Makes a technical change.
4. Becomes effective on the general effective date.
