survival of action; deceased sheriff.
Purpose
Repeals the ability for an action brought against a sheriff or the sheriff's deputies to be prosecuted against the sheriff's personal representative in like manner as if the cause of action survived at common law.
Background
Any action for the malfeasance, misfeasance or nonfeasance of a sheriff or the sheriff's deputies may be prosecuted against the personal representative of the sheriff in like manner as if the cause of action survived at common law (A.R.S. § 11-452).
There is no anticipated fiscal impact to the State General Fund associated with this legislation.
Provisions
1. Repeals the ability to prosecute a sheriff or the sheriff's deputies against the personal representative of the sheriff for malfeasance, misfeasance or nonfeasance if the cause of action survived a common law.
2. Becomes effective on the general effective date.
