SUBJECT: Strike everything amendment to S.B. 1183, relating to AZPOST; state general fund
Purpose
Removes the Peace Officers' Training Fund from the Criminal Justice Enhancement Fund monies distribution and increases the percentages for outlined recipients. Appropriates $5,000,000 from the state General Fund (state GF) in FY 2023 to the Peace Officers' Training Fund.
Background
The Criminal Justice Enhancement Fund consists of monies collected from a 42 percent penalty assessment on fines, violations, forfeitures and penalties imposed by the courts for criminal offenses and civil motor vehicle statute violations. Criminal Justice Enhancement Fund monies are distributed to specified funds for specified purposes as prescribed (JLBC Baseline).
The Arizona Peace Officer Standards and Training Board (Board) consists of 13 members appointed by the Governor. The Board must prescribe minimum qualifications for officers to be appointed to enforce the laws of the state and political subdivisions and certify officers in compliance with the qualifications. The Board must prescribe minimum courses of training and minimum standards for training facilities for law enforcement officers (A.R.S § 41-1822).
The strike-everything amendment to S.B. 1183 appropriates $5,000,000 from the state GF in FY 2023 to the Peace Officers' Training Fund.
Provisions
1. Increases the distribution percentages of Criminal Justice Enhancement Fund monies to outlined recipients to:
a) 20.81 percent from 19.09 percent, to the Department of Public Safety Forensics Fund;
b) 3.57 percent from 1.84 percent, to the Arizona Department of Juvenile Corrections;
c) 5.18 percent from 3.45 percent, to the Prosecuting Attorneys' Advisory Council Training Fund;
d) 12.38 percent from 10.66 percent, to the Supreme Court for reducing juvenile crime;
e) 10.01 percent from 8.29 percent, to Department of Public Safety for allocation to state and local law enforcement authorities for the outlined purposes;
f) 12.38 percent from 10.66 percent, to the Department of Law for allocation to county attorneys;
g) 8.59 percent from 6.86 percent, to the Supreme Court for enhancing the courts' ability to process proceedings relating to domestic violence;
h) 15.06 percent from 13.34 percent, to county sheriffs;
i) 3.52 percent from 1.79 percent, to the Arizona Criminal Justice Commission;
j) 4.34 percent from 2.62 percent, to the Department of Public Safety Forensics Fund; and
k) 4.16 percent from 2.43 percent, to the Supreme Court for providing drug treatment services to adult probationers.
2. Removes the Peace Officers' Training Fund as a recipient from the Criminal Justice Enhancement Fund monies.
3. Appropriates $5,000,000 from the state GF in FY 2023 to the Peace Officers' Training Fund.
4. Exempts the appropriation from lapsing.
5. Makes technical and conforming changes.
6. Becomes effective on the general effective date.
