armed robbery; deadly weapon; classification
Purpose
Classifies taking possession or attempting to take possession of a deadly weapon while in the course of committing robbery as armed robbery.
Background
An offender commits robbery if, against another person's will, the offender takes another person's property from their person or their immediate presence and the offender threatens or uses force against the person with intent to either coerce surrender of property or to prevent resistance to the offender taking or retaining property. Robbery is a class 4 felony (A.R.S. § 13-1902).
A person commits armed robbery if, in the course of committing robbery, a person or an accomplice: 1) is armed with a deadly weapon or a simulated deadly weapon; or 2) uses or threatens to use a deadly weapon or dangerous instrument or a simulated deadly weapon. Armed robbery is a class 2 felony (A.R.S. § 13-1904).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Classifies, as armed robbery, taking possession or attempting to take possession of a deadly weapon while in the course of committing robbery.
2. Makes technical changes.
3. Becomes effective on the general effective date.
