government mask mandate; prohibition

Purpose

Prohibits the state or any political subdivision, including the judiciary, that receives or uses tax revenue (governmental entity) from imposing any requirement to wear a mask or face covering on any Arizona resident, except where long-standing workplace safety and infection control measures that are unrelated to COVID-19 may be required.

Background

 An Arizona business is not required to enforce a state, municipal, county or other jurisdictional mask mandate on its patrons (A.R.S. 44-7951).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Prohibits a governmental entity from imposing any requirement to wear a mask or face covering on any Arizona resident, except where long-standing workplace safety and infection control measures that are unrelated to COVID-19 may be required.

2.   Defines governmental entity.

3.   Becomes effective on the general effective date.
