neighborhood occupantless electric vehicles
Purpose
Outlines requirements and operational restrictions for neighborhood occupantless electric vehicles (NOEV).
Background
A neighborhood electric vehicle is a self-propelled motor vehicle that: 1) is emission free; 2) has at least four wheels in contact with the ground; and 3) complies with the definition and standards for low-speed vehicles set forth in the federal law. A neighborhood electric shuttle includes the same standards prescribed above, including the capability to drive at least eight passengers (A.R.S. § 28-101).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Defines NOEV as a neighborhood electric vehicle that is not designed, intended or marketed for human occupancy.
2. Allows an NOEV to be operated on a highway with a posted speed limit of 45 miles per hour or less.
3. Allows
an NOEV to cross an intersection on a highway with a posted speed limit that is
over
45 miles per hour.
4. Requires
an NOEV, when operating on a highway with a posted speed limit that is between
35 and 45 miles per hour, to:
a) operate in the right-hand travel lane or as close as practicable to the right-hand curb or edge of the highway, except when preparing for a left turn;
b) turn off the roadway, on a highway with two travel lanes, to a controlled stop as soon as practicable and when it is safe to do so to allow faster moving vehicles to pass when passing is unsafe because of traffic in the opposite direction or other conditions, while there are five or more vehicles immediately behind the vehicle; and
c) display a sign that follows details outlined.
5. Makes technical and conforming changes.
6. Becomes effective on the general effective date.
