AMENDED
county salaries; precinct officers.
Purpose
Replaces salary ranges for constables with a uniform salary based on the number of voters in their precincts.
Background
Constables must attend the courts of justices of the peace within their precincts when required and must execute, serve and return all processes, warrants and notices directed or delivered by a justice of the peace or a competent authority. These duties may be enforced by the presiding judge of the superior court in the county, including the use of the power of contempt. A constable who is duly elected or who is appointed by the county board of supervisors has the authority of a peace officer only in the performance of the constable's official duties. A constable may execute, serve and return processes and notices within any precinct in another county if that precinct adjoins the precinct in which the constable was elected or appointed (A.R.S. § 22-131).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Increases the annual salary for a constable who serves more than 100 documents:
a) for precincts with 5,000 or fewer registered voters, to $35,000 from a maximum of $16,500;
b) for precincts between 5,000 and 10,000 registered voters, to $45,000 from a maximum of $26,000;
c) for precincts between 10,000 and 12,000 registered voters, to $55,000 rather than a range of between $29,437 and $40,000;
d) for precincts between 12,000 and 16,000 registered voters, to $65,000 rather than a range of between $36,100 and $50,000; and
e) for precincts with 16,000 or more registered voters, to $75,000, rather than a range of between $48,294 and $67,000.

3. Becomes effective on the general effective date.
