Purpose

Continues the Arizona Department of Corrections, Rehabilitation and Reentry (ADCRR) for eight years. Requires the Auditor General to conduct additional audits of ADCRR as outlined.

Background

The ADCRR serves the purpose of encompassing the various institutions, facilities and programs which are now or may become a part of the correctional program of Arizona, and to provide the supervisory staff and administrative functions at the state level of all matters relating to the institutionalization, rehabilitation and community supervision functions of all adult offenders (A.R.S. § 41-1602).

The Senate Judiciary Committee of Reference met on January 20, 2022, and the House Judiciary Committee of Reference met on January 19, 2022, to conduct a review of the ADCRR. The Senate Judiciary Committee of Reference recommended that the ADCRR be continued for eight years (Senate COR Report). The House Judiciary Committee of Reference recommended that the ADCRR be continued for three years (House COR Report). ADCCR is set to terminate on July 1, 2022, unless legislation is enacted for its continuance (A.R.S. § 41-3022.15).

There is no anticipated fiscal impact to the State General Fund associated with this legislation.

Provisions

1.   Continues, retroactive to July 1, 2022, the ADCRR until July 1, 2030.

2.   Repeals the ADCRR on January 1, 2031.

3.   Requires the Auditor General to annually review ADCRR's compliance with all of the following:

a)   the inmate transition program;

b)   release and reporting provisions relating to the inmate transition program;

c)   the requirement to provide rehabilitation, and the number of inmates who enroll and participate in and complete ADCRR's rehabilitative self-improvement and treatment programs by institution and a description of each program;

d)   the earned release credit program;

e)   the reporting requirements for drug and alcohol treatment programs; and

f) ADCRR's own policies regarding industry recommended reporting guidelines.

4.   Requires the Auditor General, by September 1, 2023, and each year thereafter, to submit a report to the Governor, President of the Senate, Speaker of the House of Representatives and JLAC and the Secretary of State.

5.   Requires the report to contain the Auditor General's findings relating to the review of outlined ADCRR programs.

6.   Allows the Legislature to annually assess whether ADCRR is meeting requirements for the inmate transition program and the early release program, request the Auditor General to conduct an additional audit of ADCRR and amend the termination date of ADCRR.

7.   Repeals session law relating to legislative assessment and additional auditing on July 1, 2030.

8.   Makes technical and conforming changes.

9.   Contains a purpose statement.

10.  Becomes effective on the general effective date.

Amendments Adopted by the House of Representatives

1.   Requires ADCRR to implement specific recommendations from Auditor General Reports as outlined.

2.   Requires the Auditor General to issue follow-up reports on ADCRR recommendation implementation as well as transition and early release program compliance and submit the reports to specified government entities.

3.   Allows the Legislature to amend the termination date of ADCRR.
