FACT SHEET FOR S.B. 1407

 

Governmental Mall; legislative council

Purpose

Transfers oversight of Wesley Bolin Memorial Plaza and the authorization and construction of a monument or memorial within the Governmental Mall from the Arizona Department of Administration (ADOA) to Legislative Council.

Background

The Governmental Mall is the area with a western boundary of 19th Avenue, a northern boundary of all lots abutting Van Buren Street, an eastern boundary of 7th Avenue and a southern boundary of the Harrison Street alignment. ADOA is required to: 1) develop, maintain and amend a comprehensive long-range general plan for the development of the Governmental Mall; 2) approve requests for new construction within the Governmental Mall; and 3) review all planning activities within the mall (A.R.S. § 41-1362). ADOA is responsible for the oversight of the Governmental Mall, including reviewing and approving new monuments and alterations and modifications to existing monuments. ADOA is also responsible for administering the State Monument and Memorial Repair Fund used to maintain, repair, recondition and relocate existing monuments (A.R.S §§ 41-1362; 41-1363; 41-1364; and 41-1365).

The Legislative Council is responsible for the allocation of space, operation, alteration, renovation and control of: 1) State Capitol Museum; 2) the legislative services wing; 3) any other facility acquired for the legislative use and placed under Legislative Council jurisdiction and the grounds adjacent to it; and 4) the grounds adjacent to the State Capitol Museum, the legislative services wing, the House of Representatives and the Senate wings and comprising the area east of the State Capitol Executive Tower with a northern boundary of West Adams Street, an eastern boundary of Seventeenth Avenue and a southern boundary of West Jefferson Street. The Speaker of the House of Representatives and the President of the Senate are responsible for the specified parking lot areas adjacent to each respective legislative wing (A.R.S. § 41-1304.05).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Transfers oversight of the authorization and construction of a monument or memorial within the Governmental Mall from ADOA to Legislative Council, including:

a)   review and approval of the design, dimensions and location of a new monument or memorial; and

b)   administration of the State Monument and Memorial Repair Fund and accounting and reporting for the monies of a specific monument or memorial.

2.   Asserts that Legislative Council is responsible for the allocation of space, operation, alteration, renovation and control of Wesley Bolin Memorial Plaza, except for the parking lot areas allocated and controlled by the President of the Senate.

3.   Makes technical and conforming changes.

4.   Becomes effective on the general effective date.

Amendments Adopted by Committee of the Whole

1.   Reinserts oversight of the Government Mall to ADOA, rather than the Legislative Council, for the following:

a)   development and maintenance of a comprehensive long-range general plan for the development of the Governmental Mall; and

b)   review and approval of new buildings, improvements or activities within the Governmental Mall.

2.   Asserts Legislative Council is responsible for the allocation of space, operation, alteration, renovation and control of Wesley Bolin Memorial Plaza.

3.   Reinserts the requirement that the City of Phoenix annually inform ADOA, rather than the Legislative Council, of new major development projects and infrastructure improvements within the downtown area redevelopment plan.

4.   Makes technical and conforming changes.
