FACT SHEET FOR S.B. 1477

 

voter registration; felonies; clerk; database

Purpose

Requires a clerk of the superior court to send a monthly record of felony convictions to the Secretary of State (SOS) to notify the appropriate county recorder. Requires the SOS and a county recorder to only use the record for canceling a convicted felon from the statewide voter registration database.

Background

A person convicted of treason or a felony may not be registered to vote and must remain ineligible until the person receives full restoration of civil rights (A.R.S. §§ 13-907; 16-101; and 16-152). The SOS is responsible for receiving periodic electronic reports of convicted individuals from Arizona superior courts. Upon receipt and confirmation, the SOS must import the name, date of birth and social security number of the persons convicted into the statewide voter registration system, where the system compares the felony records against the statewide voter registration database to detect matches. When a match is found, the voter registration of a convicted person must either be: 1) automatically canceled from the statewide voter registration database; or
2) flagged to be reviewed by the appropriate county recorder to determine if the voter registration should be canceled (EPM Ch 1(VIII)(A)(2)).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Requires a clerk of the superior court to transmit to the SOS a monthly record of every felony conviction within the county in the preceding month, including only the convicted person's:

a)   name;

b)   date of birth;

c)   social security number;

d)   legal address, if available; and

e)   father's or mother's maiden name, if available.

2.   Requires the SOS to only use the record for canceling a convicted felon from the statewide voter registration database.

3.   Requires the SOS to notify the appropriate county recorder and requires the county recorder to cancel the voter registration of the convicted felon.

4.   Becomes effective on the general effective date.
