Purpose
Resolves conflicting statutes relating to the calculation of career technical education district (CTED) average daily membership (ADM).
Background
Laws 2021, Chapter 404 allows a student in an approved career and technical education (CTE) centralized campus or leased centralized campus program to generate ADM during any day of the week and at any time during the fiscal year (A.R.S. § 15-393).
Laws 2021, Chapter 416 allows a student in an approved CTE centralized campus, leased centralized campus or satellite campus program to generate ADM for instruction received in any hour of the day, during any day of the week and at any time during the fiscal year. The legislation also prescribed CTED ADM calculations based on instructional hours received and community college credits earned (A.R.S. § 15-393; Version 2).
Due to the conflicting language enacted in Laws 2021, Chapter 404 and Laws 2021, Chapter 416, two versions of the affected statute were enacted (Legislative Council).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Resolves conflicting statutes relating to the calculation of CTED ADM by allowing a student in an approved CTE program to generate ADM for instruction received in any hour of the day, during any day of the week and at any time during the fiscal year.
2. Makes conforming changes.
3. Becomes effective on the general effective date, retroactive to September 29, 2021.
