Purpose
Appropriates $30,121,100 from the Children's Health Insurance Program Fund (Fund) and $1,440,732,800 of Medicaid Expenditure Authority in FY 2022 to implement the American Rescue Plan Act of 2021 (ARPA) home and community-based services spending plan and adjust funding formula requirements. Appropriates $15,100,000 of Medicaid Expenditure Authority in FY 2022 to the Department of Child Safety (DCS).
Background
The Arizona Health Care Cost Containment System (AHCCCS) contracts with health professionals to provide medically-necessary health and medical services to eligible members.
The Division of Developmental Disabilities (DDD) within the Department of Economic Security provides services to individuals with developmental and intellectual disabilities including cerebral palsy, autism and epilepsy. Services provided by DDD include: 1) attendant care; 2) habilitation; 3) home health aide; 4) home nursing; 5) occupational, physical and speech therapies; 6) respite care; and 7) medical services.
On March 11, 2021, ARPA was enacted to provide states with financial assistance. As of December 23, 2021, Arizona has received $2,100,000,000 of the total $4,200,000,000 ARPA allocation (JLBC). ARPA increased the Federal Medical Assistance Percentage by 10 percent for home and community-based services (ARPA).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Appropriates $30,121,100 from the Fund and $1,078,032,800 of Medicaid Expenditure Authority to AHCCCS in FY 2022 to implement the ARPA home and community-based services spending plan and adjust funding formula requirements.
2. Appropriates $362,700,000 of Medicaid Expenditure Authority in FY 2022 to DDD to implement the ARPA home and community-based services spending plan.
3. Prohibits AHCCCS from using any of the appropriated monies for marketing.
4. Requires any direct payments or grants provided with the appropriated monies to include a notification to the recipient that the monies are onetime funding.
5. Requires AHCCCS to provide quarterly reports to the Joint Legislative Budget Committee, at the same time the information is provided to the Centers for Medicare and Medicaid Services, that reflect any changes to the AHCCCS spending plan for the ARPA implementation.
6. Appropriates $15,100,000 of Medicaid Expenditure Authority in FY 2022 to DCS to continue existing functionality and oversight and to claim available federal monies that will expire and revert to the federal government.
7. Exempts the appropriations from lapsing.
8. Becomes effective on signature of the Governor.
