challengers; polling places; tabulation observation

Purpose

Requires, rather than allows, the county chairperson for each political party to designate a party agent or representative to act as challenger for each precinct. Requires a party challenger to remain in the polling place until completion of tabulation and transmission of votes to the county recorder.

Background

The county chairperson of each political party may designate, by written appointment addressed to the election board, a party agent or representative for each precinct and alternates for a polling place in the precinct who may act as challengers for the political party. One challenger for each political party may be present at each polling place. No more than the number of party representatives for each party which were mutually agreed upon by each political party represented on the ballot may be in the polling place at one time. If an agreement cannot be reached, the number of representatives is limited to one for each political party. A challenger or party representative must be a resident and registered to vote in Arizona (A.R.S. § 16-590).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Requires, rather than allows, a county chairperson for each political party to designate a party agent or representative to act as challenger for each precinct by written appointment addressed to the election board.

2.   Requires, rather than allows, one challenger for each political party to be present at each voting place.

3.   Requires one party representative for each political party represented on the ballot, rather than the number of party representatives for each party which were mutually agreed upon by each political party represented on the ballot, to be in the polling place at one time.

4.   Requires a party representative to remain in the polling place until completion of the tabulation of votes in the polling place and transmittal or delivery of the results to the county recorder or other officer in charge of elections.

5.   Requires the election process to continue regardless of whether the challengers or party representatives are present.

6.   Makes technical changes.

7.   Becomes effective on the general effective date.
