death registration; notification requirements

Purpose

 Requires the State Registrar of Vital Records (Registrar) to monthly transmit death records of each deceased Arizona resident who is at least 16 years old to the Motor Vehicle Division (MVD) of the Arizona Department of Transportation and the Arizona Department of Revenue (ADOR).

Background

 The Registrar is the Director of the Department of Health Services (DHS), who is charged with monthly transmitting the death records for each resident of the county recorder's county who is at least 16 years old to the county recorder (A.R.S. § 36-302).

Current statute requires DHS to transmit to the Secretary of State a record of the death of every Arizona resident reported to DHS within the preceding month for the sole purpose of canceling the names of deceased persons from the statewide voter registration database. The name of each deceased person must promptly be canceled from the statewide voter registration database and the Secretary of State must notify the appropriate county recorder, who must cancel the name of the person from the register (A.R.S. § 16-165).

               There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Requires the Registrar to monthly transmit a record of the death of each deceased Arizona resident who is at least 16 years old to the MVD and ADOR.

2.   Makes a technical change.

3.   Becomes effective on the general effective date.
