military and transitional housing; fund
(NOW: military transitional housing fund; monies)
Purpose
Establishes the Military Transitional Housing Fund (Fund) and specifies how Fund monies are to be spent.
Background
The Arizona Department of Housing (ADOH) is responsible for establishing policies, procedures and programs that ADOH may conduct to address affordable housing issues, including housing issues of low-income families, moderate income families, housing affordability, special needs populations and decaying housing stock. ADOH must provide to qualified housing participants and political subdivisions of Arizona financial, advisory, consultative, planning, training and educational assistance for the development of safe, decent and affordable housing, including housing for low- and moderate- income households. ADOH is responsible for maintaining and enforcing standards of quality and safety for manufactured homes, mobile homes and factory-built buildings (A.R.S. § 41-3953).
The Director of ADOH (Director) serves at the pleasure of the Governor and is tasked with administering ADOH (A.R.S. § 41-3952).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Establishes the Fund consisting of monies from federal sources from affordable housing legislation and unused or undesignated donations and federal monies for which military transitional housing is eligible.
2. Requires the Director to administer the Fund and specifies that the monies in the Fund are continuously appropriated.
3. Requires monies in the Fund to be deposited by the Governor and be spent on newly constructed transitional housing, in cooperation with veteran owned and operated nonprofit organizations and for-profit organizations that serve military members and veterans that serve military members transitioning to veteran status.
4. Requires Fund monies to be spent for developing projects and programs that provide transitional housing opportunities for military members separating from the military to be housed in newly-constructed housing facilities.
5. Requires the Director, by September 1 of each year, to submit a report to the President of the Senate and Speaker of the House of Representatives and provide a copy to the Secretary of State that includes:
a) a summary of facilities funded during the preceding fiscal year;
b) the cost and geographic location of each facility;
c) the number of individuals who are benefiting from the operation; and
d) the purchase or construction of a facility.
6. Requires ADOH to notify any city, town, county or tribal government that a project is planned for its jurisdiction.
7. Requires ADOH, before proceeding with a project, to receive a comment from the governing body of the applicable city, town, county or tribal government or an official authorized by the governing body.
8. Prohibits monies in the Fund from being spent on unoccupied hotels and motels designated for homeless veterans.
9. Prohibits ADOH from using more than 10 percent of the Fund monies to administer the Fund.
10. Prohibits ADOH from attempting to override a local jurisdiction's planning, zoning or land use regulations.
11. Exempts the monies in the Fund from lapsing.
12. Defines undesignated federal monies.
13. Becomes effective on the general effective date.
Amendments Adopted by Committee of the Whole
