AN ACT

 

amending Title 15, chapter 2, article 2, Arizona Revised Statutes, by adding section 15-240; appropriating monies; relating to the department of education.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 15, chapter 2, article 2, Arizona Revised Statutes, is amended by adding section 15-240, to read:

START_STATUTE15-240. Career technical adult education fund; grants; policies and procedures

A. The career technical adult education fund is established consisting of legislative appropriations, gifts, grants and other donations.  Monies in the fund are continuously appropriated.  The department of education shall administer the fund and may retain up to three percent of the monies in the fund for the purposes of administering the fund.

B. The department of education shall use monies in the fund to support adult education programs offered by career technical education districts through grants awarded to career technical education districts.  Grant monies received by a career technical education district under this section may be used for the following purposes:

1. Tuition assistance for adult learners for a career technical education district program that on completion does not result in a postsecondary degree.

2. Capital expenditures to support career technical education district programs and to maintain industry-standard facilities.

C. The department of education may both:

1. Adopt policies and procedures to manage the career technical adult education fund.

2. Establish a grant application in collaboration with career technical education districts. END_STATUTE

Sec. 2. Appropriations; career technical adult education fund; exemption

A. The sum of $5,000,000 is appropriated from the state general fund in each of fiscal years 2022-2023, 2023-2024 and 2024-2025 to the career technical adult education fund established by section 15-240, Arizona Revised Statutes, as added by this act.

B. The appropriations made in subsection A of this section are exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations, except that all monies remaining unexpended or unencumbered in the career technical adult education fund established by section 15-240, Arizona Revised Statutes, as added by this act, on July 1, 2025 revert to the state general fund.
