AN ACT
amending title 13, chapter 36, Arizona Revised Statutes, by adding section 13-3604; relating to family offenses.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 13, chapter 36, Arizona Revised Statutes, is amended by adding section 13-3604, to read:
13-3604. Unlawful abortion medication; classification; definition
A. It is unlawful for a person or entity to manufacture, distribute, prescribe, dispense, sell or transfer an abortion medication that is intended to cause or induce an abortion.
B. A violation of this section is a class 3 felony.
C. This section does not apply to either of the following:
1. The mother of the child whose death results from using an abortion medication.
2. The sale, use, prescribing or administration of any contraceptive agent that is administered before conception or before a pregnancy can be confirmed through conventional medical testing.
D. For the purposes of this section, "abortion medication" includes RU-486, mifepristone, mifegyne or mifeprex or any substantially similar generic or nongeneric abortifacient drug.
Sec. 2. Conforming legislation
The legislative council staff shall prepare proposed legislation conforming the Arizona Revised Statutes to the provisions of this act for consideration in the Fifty-sixth Legislature, first regular session.
