An Act

 

repealing title 36, chapter 6, article 4.2, Arizona Revised Statutes; amending title 36, chapter 6, Arizona Revised Statutes, by adding a new article 4.2; relating to public health.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Repeal

Title 36, chapter 6, article 4.2, Arizona Revised Statutes, is repealed.

Sec. 2. Title 36, chapter 6, Arizona Revised Statutes, is amended by adding a new article 4.2, to read:

ARTICLE 4.2. PUBLIC HEALTH MANDATES

START_STATUTE36-681. Vaccinations; enforcement prohibition; violation; classification; definition

A. ANY GOVERNMENTAL ENTITY MAY NOT require A PERSON UNDER eighteen YEARS OF AGE to RECEIVE A VACCINATION FOR COVID-19 OR ANY VARIANT OF COVID-19 without the consent of a parent or guardian.

B. A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A CLASS 1 MISDEMEANOR.

C. THE COUNTY ATTORNEY MAY PROSECUTE ANY VIOLATION OF THIS SECTION.

D. FOR THE PURPOSES OF THIS SECTION, "GOVERNMENTAL ENTITY" MEANS THIS STATE or ANY POLITICAL SUBDIVISION OF THIS STATE THAT RECEIVES AND USES STATE TAX REVENUES. END_STATUTE

Sec. 3. Short title

This act may be cited as the "Health Care Freedom Act".
