An Act

 

amending title 36, chapter 29, article 1, Arizona Revised Statutes, by adding section 36-2905.05; repealing section 36-2905.05, Arizona Revised Statutes; appropriating monies; relating to the Arizona health care cost containment system administration.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 36, chapter 29, article 1, Arizona Revised Statutes, is amended by adding section 36-2905.05, to read:

START_STATUTE36-2905.05. Eligibility redetermination; prohibitions

A. On or before December 31, 2023, the administration shall issue decisions on redeterminations for all members who have not been redetermined for eligibility since December 1, 2022 and who were identified as factually ineligible through the administration's auto-renewal process based on information provided electronically from federal and state databases that provide financial and other eligibility information.

B. The administration may not:

1. Establish procedural requirements to complete redeterminations or removals beyond the minimum procedures required to establish a good faith effort or any other minimum requirements under federal law.

2. Follow, conform to or submit to any federal guidance that is contrary to the requirements of this section, follow any other timelines or deadlines or limit, divide or disburse the initiation or completion of redeterminations or removals, unless required to do so under federal law. END_STATUTE

Sec. 2. Delayed repeal

Section 36-2905.05, Arizona Revised Statutes, as added by this act, is repealed from and after December 31, 2024.

Sec. 3. Arizona health care cost containment system administration; reporting; delayed repeal

A. On or before May 15, 2023 through May 15, 2024, the Arizona health care cost containment system administration shall submit a monthly report to the governor, the president of the senate and the speaker of the house of representatives and shall provide a copy of this report to the secretary of state of the following information:

1. The total number of Arizona health care cost containment system members who were due for renewal in the prior month.

2. The total number of Arizona health care cost containment system members for whom a renewal was initiated in the prior month.

3. Of the Arizona health care cost containment system members due for a renewal, the number of members who were renewed and remained enrolled in either the Arizona health care cost containment system or the children's health insurance program.

4. Of the Arizona health care cost containment system members due for a renewal, the number of members who were determined ineligible for Arizona health care cost containment system or the children's health insurance program and who transferred to the federally facilitated marketplace.

5. Of the Arizona health care cost containment system members due for a renewal, the number of members whose eligibility was terminated for procedural reasons such as a failure to respond to a request for information.

6. Of the Arizona health care cost containment system members due for a renewal, the number of members whose renewal was not completed.

B. This section is repealed from and after December 31, 2024.

Sec. 4. Appropriations; Arizona health care cost containment system administration

In addition to any other appropriations made in fiscal year 2022-2023, the sum of $29,243,800 from the children's health insurance program fund established by section 36-2995, Arizona Revised Statutes, and $1,653,957,950 from expenditure authority are appropriated in fiscal year 2022-2023 to the Arizona health care cost containment system administration for adjustments in formula requirements.

Sec. 5. Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
