An Act
amending title 9, chapter 4, article 8, Arizona Revised Statutes, by adding section 9-500.49; amending title 11, chapter 2, article 4, Arizona Revised Statutes, by adding section 11-269.27; amending section 36-2066, Arizona Revised Statutes; relating to residential inspections.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-500.49, to read:
9-500.49. Sober living homes; fire and zoning inspections; definition
A. A city or town may conduct inspections at a sober living home that is located in the city or town to ENSURE compliance with municipal fire codes and zoning ordinances.
B. for the purposes of this section, "sober living home" has the same meaning prescribed in section 36-2061.
Sec. 2. Title 11, chapter 2, article 4, Arizona Revised Statutes, is amended by adding section 11-269.27, to read:
11-269.27. Sober living homes; unincorporated areas; fire and zoning inspections; definition
A. A county may conduct inspections at a sober living home that is located in an unincorporated area of the county to ENSURE compliance with county fire codes and zoning ordinances.
B. for the purposes of this section, "sober living home" has the same meaning prescribed in section 36-2061.
Sec. 3. Section 36-2066, Arizona Revised Statutes, is amended to read:
36-2066. Posting; confidential information
The department shall post on its public website the name and telephone number of each certified and licensed sober living home and shall update the list quarterly. The department may not disclose the address of a certified or licensed sober living home except to a local jurisdiction for zoning regulation purposes relating to the use of buildings, structures and land and fire code and zoning ordinance compliance INSPECTIoNs pursuant to sections 9-500.49 and 11-269.27 and local law enforcement and emergency personnel. A sober living home's address is not a public record and is not subject to title 39, chapter 1, article 2.
