amending title 18, Arizona Revised Statutes, by adding chapter 7; relating to information technology.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 41, Arizona Revised Statutes, is amended by adding chapter 7, to read:

CHAPTER 7

GOVERNMENT INFORMATION TECHNOLOGY USAGE

ARTICLE 1. GENERAL PROVISIONS

START_STATUTE18-701. Internet access; explicit sexual material; government-issued identification; age verification; definitions

A. A person, including an individual or a commercial entity, that publishes or distributes explicit sexual material on the internet from a website that contains a substantial portion of explicit sexual material shall require a user of the website to provide A government-issued identification to verify that the user is at least eighteen years of age before being granted access to the website.

B. Any person, including an individual or a commercial entity, that performs the required age verification described in subsection A of this section may not retain any IDENTIFYING information of the user of the website after access has been granted to the explicit sexual material.

C. For the purposes of this section:

1. "Explicit sexual material" has the same meaning prescribed in section 8-309.

2. "Identifying information" means an individual's:

(a) Driver license number.

(b) Nonoperating identification license number.

(c) Date of birth.

(d) Residential address.

(e) Unique biometric data.

3. "Internet" has the same meaning prescribed in section 18-541. END_STATUTE
