An Act
relating to amusements.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Department of gaming regulatory assessment; pari-mutuel pool
Notwithstanding any other law, in fiscal year 2023-2024, the department of gaming shall establish and collect a regulatory assessment from each commercial racing permittee, payable from amounts deducted from pari-mutuel pools by the permittee, in addition to the amounts the permittee is authorized to deduct pursuant to section 5-111, subsection B, Arizona Revised Statutes, from amounts wagered on live and simulcast races from in-state and out-of-state wagering handled by the permittee, in the amount of 0.5 percent of the amounts wagered.
Sec. 2. Department of gaming; event wagering operator license application fees; refund
A. Notwithstanding any other law, during fiscal year 2023-2024, the department of gaming shall issue refunds for any event wagering operator license application fees associated with the Indian tribes listed in subsection B of this section.
B. The department of gaming shall issue refunds pursuant to subsection A of this section to the following Indian tribes:
1. Cocopah Indian tribe.
2. Colorado River Indian tribe.
3. Pascua Yaqui tribe.
4. Yavapai-Apache nation.
5. White Mountain Apache tribe.
6. Havasupai tribe.
Sec. 3. Exposition and state fair board permanent revolving fund; fund balance
Notwithstanding section 3-1005, subsection D, Arizona Revised Statutes, for fiscal year 2023-2024, the balance of the exposition and state fair board permanent revolving fund established by section 3-1005, Arizona Revised Statutes, may not exceed $60,000, except for the period beginning fifteen days before the beginning of the 2023 Arizona state fair and ending fifteen days after the conclusion of the 2023 Arizona state fair, when the amount of the fund may not exceed $400,000.
