HOUSE OF REPRESENTATIVES AMENDMENTS TO S.B. 1286

Strike everything after the enacting clause and insert:
"Section 1. Title 18, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 18-105, to read:
18-105. Public agencies; software licensure; prohibition; definition
A. A contract entered into by a public agency for the licensing of software applications designed to run on generally available desktop or server hardware may not restrict the public agency's ability to install or run the software on the hardware of the public agency's choosing, including that such a contract may not require that the software run on hardware dedicated solely to the agency.
B. For the purposes of this section, "Public Agency":
1. Means this state, the Arizona board of regents or a city, charter city, county, district, public authority or other political subdivision of this state.
2. Does not include a political subdivision that operates a federal reclamation project.
Sec. 2. Applicability
This act applies to any contract or addendum entered into from and after the effective date of this act."
