Page 2, after line 4, insert:
"Sec. 2. Title 40, chapter 2, article 6.2, Arizona Revised Statutes, is amended by adding section 40-360.14, to read:
40-360.14. Applicability
A. This article does not apply to a transmission line if:
1. the structures are located WITHIN the substation fence or generating site to which the line connects.
2. The owner of the project provides written notice to the committee stating that an exemption to this article applies. The notice must describe how a challenge to the transmission line exemption may be made as described in subsection B of this section. The committee shall post the notice on the commission's website.
3. The transmission line is shorter than one mile in length as measured from the first structure outside of the substation, switchyard or generating site to which the line connects to the fifth structure.
B. An individual who resides within one mile of the transmission line, an Indian tribe or an entity in this state that is qualified under section 501(c) of the United States internal revenue code for federal income tax purposes may challenge in writing a transmission line's exemption from this article. Within thirty days after the committee posts the notice pursuant to subsection A, paragraph 2 of this section, The INDIVIDUAL, Indian tribe or entity shall submit a challenge to the chairperson of the committee if the individual, Indian tribe or entity has a reasonable belief that one or more of the factors to be considered in issuing a certificate of environmental compatibility as listed in section 40-360.06 would be threatened if the transmission line is exempt from this article. The individual, Indian tribe or entity must substantiate the threat. The owner of the project must provide a written response within thirty calendar days after the written challenge is made. The chairperson of the committee shall determine if the exemption from this article applies to the transmission line."
