HB2080: emergency alert technology; vehicles; devices

Overview
Requires all new motor vehicles and portable wireless communication devices sold in this state to contain emergency alert technology beginning January 1, 2025.
History
Statute requires, on the immediate approach of an authorized emergency vehicle equipped with at least one lighted lamp exhibiting a red or blue and red light or lens that is giving an audible signal by siren, exhaust whistle or bell, the driver of another vehicle to: 1) yield the right-of-way; 2) immediately drive to a position parallel to and as close as possible to the right-hand edge or curb of the roadway clear of any intersection; and 3) stop and remain in the position until the authorized emergency vehicle has passed (A.R.S. § 28-775).
A motor vehicle is either a self-propelled vehicle or a vehicle that is operated on the highways of this state and that is propelled using motor vehicle fuel. This does not include a scrap vehicle, a personal delivery device, a personal mobile cargo-carrying device, a motorized wheelchair, an electric personal assistive mobility device, an electric bicycle, an electric miniature scooter, an electric standup scooter or a motorized skateboard (A.R.S. § 28-101).
A portable wireless communication device is a cellular telephone, a portable telephone, a text-messaging device, a personal digital assistant, a stand-alone computer, a global positioning system receiver or a substantially similar portable wireless device used to initiate or receive communication, information or data. This does not include a radio, citizens band radio, citizens band radio hybrid, commercial two-way radio communication device or equivalent, subscription-based emergency communication device, prescribed medical device, amateur or ham radio device or in-vehicle security, navigation or remote diagnostics system (A.R.S. § 28-914).
Provisions
1. Mandates all new motor vehicles and portable wireless communication devices sold in Arizona must contain emergency alert technology beginning January 1, 2025. (Sec. 1)
2. Defines emergency alert technology as a hands-free technology that sends an audible warning to motor vehicle drivers who are in the path of or are approaching an emergency vehicle. (Sec. 1)
