HB 2411: water supply; elimination; reduction; damages

Overview

Requires a city that provided water to customers outside the city's service area and reduced or terminated that service on or after January 1, 2023, to make the same reduction or termination of water supply to the mayor and members of the city council and specifies that the city is liable for certain damages incurred because of the termination of service.

History

A city has the power to provide itself with water and construct public wells, cisterns and reservoirs and the authority to regulate the laying of water pipes and mains. A city may authorize the establishment and regulate the use of a waterworks and sewer plant erected by a domestic corporation or association which is organized to supply cities, or their inhabitants, with water (A.R.S. §§ 9-240, 9-276).

2.   Makes the city that terminated the water service liable for the following costs for the persons whose water service was terminated:

a)   Fire damage to personal property;

b)   Health problems incurred by children as the result of the water service termination; and

c)   Attorney fees. (Sec. 1)
