Overview
Places the Automated Crime Victim Notification System (Notification System) and the associated Law Enforcement Crime Victim Notification Fund (Fund) under the auspices of the Arizona Criminal Justice Commission (ACJC).
History
The Fund is administered by the State Treasurer and used by law enforcement agencies in the State to fund the purchase of automated notification software that meets certain requirements to send updates to crime victims on the status of their investigation, report or case via email or text (A.R.S. § 41-180).
1. Transfers the administration of the Fund from the State Treasurer to ACJC. (Sec. 1)
2. Alters the Fund and its monies to be subject to continuous, instead of legislative, appropriation. (Sec. 1)
3. Places the Notification System under the administration of ACJC. (Sec. 1)
4. Requires the Notification System to comply with statutory and constitutional provisions related to victim's rights and juvenile offenders. (Sec. 1)
5. Adds and modifies various requirements which the Notification System must meet including:
a) Providing multiagency notification software that enables agencies to automatically share status updates with partner agencies;
b) Providing conversational artificial intelligence software to allow for bidirectional communication with citizens;
c) Providing a data outage tracking system to notify ACJC and the affected law enforcement agency;
d) Complying with the relevant federal guidelines; and
e) Providing a statewide toll-free number for citizens to obtain case information and to register for notifications. (Sec. 1)
6. Directs ACJC to use Fund monies to pay for law enforcement agencies that choose to use the Notification System instead of refunding law enforcement agencies for the same. (Sec. 1)
7. Requires ACJC, for FYs 2024 through 2026, to include a partnership between at least two vendors for the purpose of expanding the Notification System. (Sec. 3)
8. Adds that besides city and county law enforcement agencies, state, town, tribal, university and prosecutorial law enforcement agencies may also participate in the Notification System. (Sec. 1)
9. Creates a ten-member Sexual Assault Kit Study Committee (Study Committee) to examine the feasibility of providing crime victims with a tracking system for sexual assault forensic examination kits. (Sec. 2)
10. Directs the Study Committee to issue a committee report by December 1, 2023. (Sec. 2)
11. Repeals the Study Committee on October 1, 2024. (Sec. 2)
