Overview

Prohibits the erection of a habitation in a public street, highway, alley, lane, parkway, sidewalk or other right-of-way (public right-of-way).

History

Statute defines a right-of-way, when used within the context of the real property on which transportation facilities are constructed or maintained, as the land or interest in land within the right-of-way boundary. Rights-of-way are most notably used and purchased by government for the purpose of roads, highways, sidewalks and other transportation corridors (A.R.S. §§ 28-101; 28-363).

1.   Prohibits a person from erecting or maintaining a habitation in a public right-of-way. (Sec. 1)

2.   Specifies that habitation includes tents, tarps, boxes or similar objects. (Sec. 1)
