Overview

Adds any historic version of the American flag, including the Betsy Ross flag, to the list of flags a condominium unit owners' association (COA) and a planned community association (HOA) may not prohibit from outdoor display.

History

Currently, a COA and HOA must not prohibit the outdoor display of any of the following:

1) The American flag if it is displayed in a manner consistent with the United States Flag Code (Appropriately);

2) An official or replica of a United States uniformed services flag if it is displayed Appropriately;

3) The POW/MIA flag;

4) The Arizona state flag;

5) An Arizona Indian nations flag;

6) The Gadsden flag;

7) A first responder flag; and

8) A blue star or gold star service flag (A.R.S. §§ 33-1261, 33-1808)

Provisions

1. Stipulates a COA or HOA must not prohibit the outdoor display of any historic version of the American flag, including the Betsy Ross flag, regardless to how the stars and stripes are arranged on the flag. (Sec. 1,2)

2. Defines Betsy Ross Flag. (Sec. 1,2)

3. Makes technical and conforming changes. (Sec. 1,2)
