SB 1104: procurement; information disclosure; bidders

Overview
Establishes a question-and-answer period for competitive sealed bidding.
History
The Director of the Department of Administration (Director) may adopt rules governing the procurement and management of all materials, services and construction and the disposal of materials. The Director serves as the central procurement officer of Arizona (A.R.S. § 41-2511).
An agency chief procurement officer must issue an invitation for bids at least 14 days before the offer due date and time, unless the agency chief procurement officer determines a shorter time is necessary for a particular procurement. If a shorter time is necessary, the agency chief procurement officer must document the specific reasons in the procurement file (2 A.A.C. 7 R2-B301).
An agency chief procurement officer may conduct one or more pre-offer conferences within a reasonable time before offer due date and time to discuss the procurement requirements and receive comments from prospective offerors (2 A.A.C. 7 R2-7-C303).
Provisions
1. Requires the Director provide a question-and-answer period for bidders and interested parties outside of the procurement process and provide written responses to those questions. (Sec. 1)
2. Mandates the Director provide, in writing, all questions and answers to all bidders and interested parties, including questions raised during site visits and pre-bid conferences, outside of the procurement process. (Sec. 1)
