Committee on Judiciary

Overview

Exclude devices intended to muffle the report of a firearm from the definition of prohibited weapon.

History

Current law defines prohibited weapons to include a number of different items, including a device that is designed, made or adapted to muffle the report of a firearm. A firearm is defined as any loaded or unloaded handgun, pistol, revolver, rifle, shotgun or other weapon that can expel or may readily be converted to expel a projectile due to an explosion. This definition excludes a firearm in permanently inoperable condition. (A.R.S. § 13-3101).

A person can commit misconduct involving weapons, a class 4 felony, by knowingly manufacturing, possessing, transporting, selling or transferring a prohibited weapon (A.R.S. § 13-3102).
