SB1141: early ballot drop off; identification

Overview

Establishes attestation and identification requirements for voter's and voter's agent's who deliver one or more voted early ballots to any voting location in the county.

History

The attestation and identification requirements state that an early voter must sign the affidavit and mark the ballot in a way so that the vote cannot be seen. The early voter must then fold the ballot to conceal the vote and deposit the voted ballot in the provided envelope which must be securely sealed with the affidavit. The voter or voter's agent can then deliver the voted ballot to the County Recorder or other officer in charge of elections, or deposit the voted ballot at any polling place in the county (A.R.S. § 16-548).

A valid form of identification must bear the photograph, name and address of the elector or the elector may present two different items that contain the name and address of the elector that reasonably appear to be the same as the name and address in the precinct register (A.R.S. § 16-579)

Provisions

2.   Instructs the Election Board to require identification that confirms the voter's name is the same on the voter's affidavit envelope for any person delivering their voted early ballot to any polling place in the county. (Sec. 2)

3.   States that the Election Board must require the following for any voter's agent delivering another person's voted early ballot to any polling place in the county:

a)   Attest in writing that the voter's agent is the voter's family member, household member or caregiver; and

b)   Present identification that confirms the voter's agent's name. (Sec. 2)

4.   Classifies any violation of this law as a class 5 felony. (Sec. 2)
