SB 1211: county attorney; representation; duties

Overview
Modifies the County Attorney's representation requirements for school districts and community college districts.
History
The County Attorney must act as the attorney for school districts and community college districts except:
1) in any lawsuits involving a conflict of interest with other county offices, at which time the attorney general may represent the school district or the community college district;
2) a district board may employ an attorney to represent the district if the county attorney consents. The district board must state in writing the purpose for employing the attorney; and
3) a district board may employ an attorney without the consent of the county attorney if it deems it advisable (A.R.S §§ 11-532; 15-343; and 15-1448).
Provisions
1. Specifies that the County Attorney act as the attorney for school districts and community college districts if there is staff availability and there is no conflict of interest. (Sec. 1)
