SB1247: recycling fund; appropriation

Overview

Appropriates $2,500,000 from the Recycling Fund to the Arizona Department of Environmental Quality in fiscal year (FY) 2024 to provide grants for recycling research, demonstration projects, new technologies, market development and source reduction studies. Exempts this appropriation from lapsing.

History

The Recycling Fund is administered by the Director of the Arizona Department of Environmental Quality (ADEQ) and consists of legislative appropriations, gifts, grants, donations and monies derived from landfill disposal fees, which are collected in increments of $0.25 for each six cubic yards of uncompacted solid waste or three cubic yards of compacted solid waste (A.R.S. § 49-836). These fees generated almost $2.6 million in revenue for the fund in FY 2022. Fund monies can be used to:

1) provide grants or contracts to political subdivisions, nonprofit organizations or private enterprises for research, demonstration projects, new technologies, market development and source reduction studies and implementation of recommendations or reports;

2) fund public information, public education and technical assistance programs concerning litter control, recycling and source reduction;

3) collect and administer fund monies;

4) administer the Arizona Commerce Authority's Recycled Market Development Program; and

5) contribute to the ADEQ's Solid Waste Control Program's activities.

The ADEQ Director is required to ensure that all counties, except Maricopa and Pima Counties, receive benefits in proportion to their contributions to the fund. Additionally, the ADEQ Director must appoint an advisory committee to make recommendations on using fund monies. This advisory committee consists of:

1) two representatives from private solid waste collection businesses,

2) two representatives from private solid waste recycling businesses,

3) four representatives from political subdivisions that have implemented recycling and source reduction programs including at least one who resides in a county with a population of fewer than 500,000; and

4) one representative of the general public (A.R.S. § 49-837).

Monies in the Recycling Fund have been appropriated to other agencies, funds and programs. For example:

1) Laws 2019, Chapter 269 appropriated $2,152,000 from the fund to the Water Quality Assurance Revolving Fund in FY 2020;

2) Laws 2021, Chapter 408 appropriated $200,000 from the fund to ADEQ's Surface Water Protection Program in FY 2022;

3) Laws 2021, Chapter 408 appropriated $1,500,000 from the fund to the Water Quality Feed Fund in FY 2021; and

4) Laws 2022, Chapter 313 appropriated $1,000,000 from the fund to the Department of Forestry and Fire Management for grants to recover and process biomass waste in FY 2023.

Provisions

1. Appropriates $2,500,000 from the Recycling Fund to ADEQ in FY 2024 to provide grants for recycling research, demonstration projects, new technologies, market development and source reduction studies and exempts this appropriation from lapsing. (Sec. 1)
