SB 1253: sex offender registration; school notification

Overview
Requires a person who must be registered as a sex offender and who is the legal guardian of a student at a public or private school to annually provide notice of the person's registration status to the school's principal or administrator.
History
Current law requires person convicted of certain offenses outlined in statute to register as a sex offender. Examples include sexual conduct with a minor, sexual abuse of a victim under the age of 18, sexual exploitation of a minor or child prostitution. Additionally, a court may require any individual convicted of a violation of Title 13, Chapter 14 (sexual offenses), Title 13, Chapter 35.1 (sexual exploitation of children) or any offense where there was a finding of sexual motive to register. Individuals who are not Arizona residents but are either employed by the state of Arizona or enrolled in a school in Arizona are also required to register if convicted of outlined offenses.
A person who registers must provide specified information as required by the director of the Department of Public Safety (DPS). The applicable county sheriff is required to fingerprint and photograph the person and, within three days of doing so, must send copies of this information to DPS and the chief of police, if any, in the place where the individual resides. A registered person must comply with various ongoing notification requirements after the person's initial registration (A.R.S. § 13-3821).
Provisions
1. Requires an individual who is required to register as a sex offender pursuant to A.R.S. § 13-3821 and who is the legal guardian of a student at a public or private school to annually notify the school's principal or administrator of their registration status within 10 days of the student's enrollment. (Sec. 1)
2. If the registered individual is on probation at the time of the student's enrollment, mandates the registered individual's probation officer to annually determine whether the notification requirement still applies and verify that the school received the required notification. (Sec. 1)
