Summary of the Strike-Everything Amendment to SB 1299

Overview

Establishes processes and requirements for receiving monies, services and other things of value for a Governor's inauguration events.

History

The Governor or presiding officer of the legislature may accept and expend public or private gifts, grants, donations or monies to promote the interests of the state or to promote and encourage citizens' public service to the state (A.R.S. § 41-1105).

All specified monies received are deposited with the State Treasurer and held and retained in separate state promotional fund accounts according to the specified source and purpose of the fund. Public and private monies are not commingled in any fund account (A.R.S. § 41-1105).

Annually before January 1, the State Treasurer must prepare a written report, for the state promotional fund, to the Governor and the Legislature that includes a detailed listing naming the contributors to the accounts and a detailed listing of expenditures from the accounts. The report is considered a public record (A.R.S. § 41-1105).

Statute defines controlled business as any business in which the public officer or any member of his household has an ownership or beneficial interest, individually or combined, amounting to more than a 50 percent interest (A.R.S. 38-541).

2.   States an individual may donate monies, services or other things of value, up to $25,000, to pay for the costs of the Governor's inauguration events. (Sec. 1)

3.   States donations made from controlled businesses are aggregated with individual or entity donations. (Sec. 1)

4.   Stipulates donations made for the Governor's inauguration events are not campaign contributions and expenses. (Sec. 1)
