SB1340: toll roads; conversion; prohibition

Overview

Prohibits the Arizona Department of Transportation (ADOT) and a County Board of Supervisors (BOS) from allowing the conversion of an existing publicly funded or maintained street or highway to a toll road.

History

A toll road includes trails for the passage of saddle and pack animals and foot passengers, as well as roads designed for the passage of vehicles, if the trails have been built in mountainous or precipitous places or in other places where the building of roads for vehicles would be impracticable (A.R.S. § 28-6801).

A person who desires to construct a toll road within one or more counties must publish a notice in a newspaper that is published in each county, once each week for six successive weeks. On the day specified in the notice, a written application must be made to the respective BOS of the counties for the authority to take the necessary land and construct the road described in the notice (A.R.S. § 28-6802).

The county BOS may not grant an application if: 1) the Highway Commission files a written statement with the county BOS that the proposed toll road will interfere with an existing or proposed state highway or state route; or 2) the proposed toll road will interfere with an existing or completed county highway (A.R.S. § 28-6803).

A toll road must not interfere with a highway in general use by the traveling public. If a toll road is established or if the prior right to maintain it has been acquired, another toll road must not be constructed or maintained within one mile of either side of the road (A.R.S. § 28-6804).

Provisions

1.   Prohibits ADOT from entering into an agreement that allows the conversion of an existing publicly funded or maintained street or highway to a toll road, including a conversion for the purpose of implementing a variety of traffic management strategies. (Sec. 2)
